A former employee has taken legal action against a Michigan-based truck repair company, alleging violations of labor laws. On November 11, 2025, Duane Dean Fry filed a complaint in the United States District Court for the Western District of Michigan against Michigan Truck Solutions, LLC and its executives Craig A. Scholten, Jeremey Jones, and Scott Keena. Fry claims that the defendants failed to pay him minimum wage and overtime as required by federal and state laws.
The lawsuit accuses Michigan Truck Solutions, LLC (MTS) and its leadership of willfully violating the Fair Labor Standards Act (FLSA) and Michigan’s Improved Workforce Opportunity Wage Act (IWOWA). According to Fry, during his employment from August 2023 to April 15, 2025, he was not compensated at the legally mandated rates for all hours worked. The complaint details how Fry often worked beyond his scheduled hours without receiving appropriate overtime pay. He alleges that despite being promised $25 per hour for a standard workweek of Monday through Friday, he frequently experienced delays in payment or received no compensation at all.
Fry’s responsibilities included scheduling service appointments and preparing invoices as a Service Advisor at both River City Truck and Trailers and later MTS after it was established by Scholten in February 2025. The plaintiff contends that when he raised concerns about nonpayment with President Scott Keena, he was informed that the company lacked sufficient funds to pay him. Despite assurances from Vice President Jeremey Jones regarding overdue wages, Fry’s employment was terminated on April 14, 2025, allegedly due to company downsizing.
In his lawsuit, Fry seeks several forms of relief from the court: a declaration that his rights were violated under FLSA and IWOWA; an award for unpaid minimum wages and overtime; liquidated damages; attorney’s fees; costs; and any other equitable relief deemed appropriate by the court. The complaint emphasizes that MTS’s annual gross volume exceeds $500,000 with more than two employees each under Scholten’s ownership.
