In a dramatic legal battle unfolding in the Eastern District of Michigan, a disabled senior citizen has taken on city officials, alleging violations of his civil rights. Arnold Kuerbitz filed a complaint on November 10, 2025, against Tim Greimel and other Pontiac city employees, accusing them of conspiring to infringe upon his constitutional rights.

The case centers around Kuerbitz’s claims that the defendants violated his federal civil rights through a series of actions related to property code enforcement. On July 18, 2024, Kuerbitz was cited for “accumulation of rubbish” on his property in Pontiac, Michigan. He argues that this citation was vague and unjustified, pointing out that the alleged rubbish included items like a camper and lawnmowers. The plaintiff contends that these actions were part of a broader scheme by city officials to impose illegal taxes on properties owned by disabled seniors. He further alleges that the defendants threatened to trespass on his property and remove items without due process.

Kuerbitz also references past incidents where similar charges were dismissed against another disabled resident in Pontiac. He claims that these practices are part of an effort by the financially troubled City of Pontiac to generate revenue through false ordinance violations. Moreover, he accuses city officials of retaliating against him for exercising his right to seek redress through previous legal actions.

Seeking justice, Kuerbitz demands several forms of relief from the court. He requests declaratory and injunctive relief to prevent further discrimination and retaliation by city officials. Additionally, he seeks compensatory and punitive damages totaling $1 million for the alleged violations of his rights under federal law.

Representing himself pro se, Kuerbitz emphasizes his indigent status and asserts that he is entitled to protection under federal laws designed to safeguard the rights of disabled individuals. His complaint highlights multiple instances where he believes his constitutional rights were blatantly disregarded by those acting under color of state law.
